Terms and Conditions of Trade

The following terms and conditions are the terms on which the kitchen shop offers you access to the services and use of our on-line web site shopping facility. By shopping with the the kitchen shop website you accept these terms and conditions.  The kitchen shop gives customers convenient, quick, easy and secure purchasing options. Items displayed on the site can be purchased using the secure and reliable online MasterCard or Visa transaction facility. Shoppers have the confidence in knowing that all of their details are protected by the latest security mechanisms, and are used only for the purposes of the transaction.These terms and conditions may be amended in whole or in part by the kitchen shop from time to time. Amendments will be effective immediately upon posting of the amended terms and conditions on this website. You are responsible for ensuring you are familiar with the latest terms and conditions. Your use of this website and the services it provides represents your agreement to be bound by the terms and conditions as amended.

1. Stock Quality and Supply

All products carried by the kitchen shop and shown in this website are manufactured to a high level and is of a very high quality. Under normal circumstances we maintain stock of all of the products seen on this website.  Sometimes we cannot accurately forecast customer demand and, on very unusual circumstances certain products advertised in this website and/or in store may not be in store.  In such circumstances, we will endeavor to deliver your purchase within the period of time stated below.  If there is going to be any delay in distributing your purchase we will contact you and give you our best estimate as to when the product will be distributed to you.

2. Payment and Delivery

Purchases and delivery of products on-line from the kitchen shop are available within New Zealand and Australia. The kitchen shop will courier your purchases to anywhere in New Zealand and Australia. Orders should be dispatched for delivery by courier within 7 working days after payment has been approved and received.  You will be notified if the order is expected to take longer than 7 days. Because all deliveries are made by courier we need a physical address, not a Post Office Box. When you place an order using the "Pay and Pickup" option, your order and stock availability will be confirmed, a dispatch email is sent to you with the details for your in-store pickup. Damages and Breakages of deliveries made by courier company.  All packages to be delivered leave the kitchen shop in perfect condition. The consignee of a delivery of any goods purchased from the kitchen shop becomes solely responsible for damages and/or breakages of the delivery as soon as the consignee signs for acceptance of the delivery.  This clause follows Fastway Couriers Conditions (section 7).  We recommend you do not sign for the delivery until you have checked it for damage/ breakage.  Instead of signing for acceptance of delivery, it is within your rights to write TO BE INSPECTED.

3. Conditions of Sale, Payment & Pricing

Visa and MasterCard credit cards will be accepted. All prices are in New Zealand currency and include GST. The delivery of all the kitchen shop products will only be made if and when payment has been received.All prices are correct at time of publication; however we reserve the right to alter the price for any reason.  If this happens with an item you have ordered, we will contact you prior to delivery.  Please be aware that prices of some products available on-line may differ to the in-store prices.  Also, some items may be offered as specials on-line but not in store and vice versa. Due to the service provided, the free delivery offered to items purchased on-line will not be offered when buying the same product in-store or over the telephone.Items sold as Specials are subject to availability and we reserve the right to amend or cancel these without notice. If this happens with an item you have ordered, we will contact you prior to delivery. Your orders are not retractable once they have been received by the kitchen shop. You must only place an order if you intend to buy the relevant item at the set price.International orders are sent to Australia using the New Zealand Post Internation Courier service.  The packages can be sent to street addresses or PO Boxes.  Each package will have a track and trace number to keep track of the delivery of your purchase.  The courier charges are based on size, weight and packaging costs of each item.  These costs are a base post and packaging rate of NZ$35.00 plus NZ$2.50 per extra item and/ or NZ$2.50 per 250 grams and 25 cubic centimetres.  These weights and sizes are estimated to the best of our ability.  It is recommended that purchases over $500.00 are insured.  If an executive insurance policy is required please request this in the notes section of you order.  We will determine and notify you if an extra cost (on top of your purchase and freight total) is required.

4. Return and Refund Policy

Your satisfaction is important to us and we endeavor to sell best quality products and to maintain the best service available. Please choose carefully. If you simply change your mind, by law we do not have to refund or exchange your purchased item(s). If a product is faulty and you return it within a reasonable period, along with proof of purchase, the product will be analysed. If it is determined the damage is not caused by your negligence or misuse, the product will be repaired. If it cannot be repaired within a reasonable period, the product will be replaced with the same or an alternative product. If we do not have a similar replacement item a refund will be given. If the product is found to be faulty you will not be charged for the repaired or replaced item(s) or the packaging/delivery charges of the repaired or replaced item(s). If you are returning faulty goods, please note that risk in transit is your responsibility until we receive the goods. Please make sure any products returned to us are packed with care and sent at your own expense with a reputable courier service that will provide a track and trace facility and insurance or we will not be held responsible.  If it is found the product is NOT a faulty product, we will attempt to repair it for you free of charge.  If we are unable to repair it free of charge we will contact you and inform you of the cost of repair.  If the item is NOT faulty, you will be charged for the return delivery charge to the address of your choice.  If you agree to these charges we require payment before the product is repaired and delivered.  If your purchase was made on-line, and the return was due to a change of mind we will replace your purchase under the same terms as stated above.  However, the courier charge for the second delivery will be subtracted from the value of the goods initially purchased (not including the initial courier charge). These policies meet our obligations to provide a remedy under the New Zealand Consumer Guarantees Act.Please note: the kitchen shop sells products for domestic use only.   Products sold by the kitchen shop are NOT guaranteed for commercial use.  

5. Laybys

An initial deposit of 30% of order must be paid.  The minimum order amount for our layby service is $100.  The layby period is a maximum of three months. The deposit and any payments made towards the layby can be transferred towards paying for/towards another item within the shop or a credit note can be issued (see conditions that follow).  Sale or discounted items unless otherwise stated cannot be laybyed. If you layby an item/s that becomes a sale item during the term of your layby you accept this sale price does not apply to your layby. Our layby service is only available to NZ residents.All orders, products, items, including laybys, are the property of the kitchen shop until payment in full has been received.Items may be added to a layby (based on availability). The kitchen shop reserves the right to refuse a layby and to update the Terms and Conditions of our layby service without notice.A request to layby is considered an agreement to the Layby Terms and Conditions above.

6. Credit Notes 

Credit Notes can be issued in the event there are no suitable items for exchange upon meeting exchange conditions.  The amounts shown on the Credit Note are in New Zealand Dollars. Credit Notes issued by the kitchen shop are not redeemable for cash and are non refundable and must be redeemed within three months of the date of return. The kitchen shop does not accept cancellations or offer refunds under any circumstances in whole or part thereof once payment of the original purchase has been made and the kitchen shop Credit Note is issued.The Credit Note receiver may use their credit to make purchases of goods sold in the kitchen shop and can only be redeemed when authorised & issued by a the kitchen shop staff member.If upon redeeming your Credit Note and there is a difference between the cost payable and the Credit Note value, the difference will be subtracted from the initial credit note to be used within the initial period of 3 months months.If you decide, after redeeming your initial Credit Note, to return your goods, you can be issued with a second Credit Note which must be redeemed within one month of the date of return. The receiver of the the kitchen shop Credit Note is responsible and liable for the safety and use of the Credit Note. The kitchen shop will not be held responsible for lost or stolen the kitchen shop Credit Notes. The kitchen shop Credit Notes are to be treated like cash; defaced, mutilated, altered, lost or stolen certificates will not be replaced, refunded or redeemed.

7. Security

This the kitchen shop website endeavors to maintain a safe and secure on line shopping facility.  However, you are responsible for any activity which occurs on or through your membership account and to keep your personal information (including your email address and password, your physical address and telephone number, and your bank details) secret and secure.  You must not permit any other person to use your password or account, not to disclose to any other person your password or any other information that may allow them to gain access to your account and you must change your password immediately if you believe that your account may have been used without your authorization. 

8. Privacy

The privacy of your data, orders and credit cards are important to us. We will not disclose or sell your customer data to any third party. We will only send you email newsletters if you explicitly opt in.Credit card details are not stored anywhere on our servers or in our premises. Your credit card details are processed in real time by an independent payment gateway authorised by our bank, using secure encryption.

9. General

The kitchen shop owns the intellectual property rights and trademark of the name and logo the kitchen shop used in this website and in our shop. You may not, without our prior written permission, in any form or by any means, adapt, reproduce, copy, store, distribute, print, display, publish, perform or create derivative works from any part of this website or the kitchen shop retail shop; commercialize, copy or on-sell any information or items obtained from any part of this website or the kitchen shop retail shop.
